About

This is the third course within the field of maritime law that the Department of Law has invested in. The focus has now shifted from the vessel to its freight. The course deals with questions that might arise when handling freight contracts and rental/charter agreements for ships. Further on the course dives into the specific regulations regarding sea maritime insurance, which covers the ship, the freight and the ship owner as well as third party liability.

The more specific block in this course consists of a procedural play/exercise in which the students represent solicitors for the seller/buyer in negotiating a contract. The contract should regulate a larger batch of goods that should be transported via the/by sea from one country to another.

The course is taught in English and includes the following elements:

International rules on transport of goods: Carriage of Goods by Sea under Charter Parties, Carriage of Goods by Sea under Bills of Lading, Jurisdiction and Arbitration Clauses under Carriage of Goods by Sea, Multimodal Transport, Carriage of Goods by Road, Carriage of Goods by Rail, Carriage of Goods by Air.

Marine Insurance and General Average: Introduction to the Fundamentals of Marine Insurance, Market documents and their legal significance Legality, Insurable Interest and Doctrine of Utmost Good Faith, Warranties and other policy terms, The cover provided by marine policies, Claiming under a marine policy, Cargo policies, Hull policies, P&I Clubs.

Sale of Goods: Jurisdiction and Arbitration Issues in the Context of International Sale of Goods and Transportation, Documentary CreditsContract Drafting Exercise:Contract Drafting - Civil and Common Law Perspectives, Contract Negotiation: Practical Aspects from a Legal Practitioner, Group Negotiations.

The examination is based on the procedural play that ends the course, a written exam covering the insurance part, graded student presentations at seminaries and a thesis based on the negotiated contract.
