This session discusses the legal aspects in relation to cruise ship passenger contracts, their nature and salient features; parties to the contract and their rights and obligations. Claims arising out of passenger carriage are subject to applicable law and contract which contains standard terms and conditions. It is rare that the passengers examine the terms and conditions of the contract prior to the cruise. Whether the forum state is a party to any international convention related to passengers could be significant.
It must be stressed that not all states are parties to a particular convention that establishes international standards of the carrier's obligations and liabilities. In those states, national law will apply. The impact of electronic transactions on the formation of passenger contracts will be highlighted. The session will also give a brief overview of the revenant international regime related to passengers carried by sea. Also, a brief mention of the EU regime related to passengers and travelers will be provided.
About the speaker:
Dr. Olena Bokareva is an Associate Senior Lecturer in private law at the Faculty of Law at Lund University. She obtained her doctoral degree from Lund University in 2015 and holds her LL.M degree from the same university. Her doctoral research was based on the analysis of the Rotterdam Rules. Her academic interest lies in maritime and commercial law, carriage of goods and passengers by sea, multimodal transport and the law of the sea. She teaches maritime and transportation law at the Faculty of law and selected topics in EU law.
