Description:

The unprecedented sanctions which followed the Russian invasion of Ukraine have posed multiple issues for the shipping industry and global trade, not least for those trading with Russian partners and carriers of Russian cargo. This case summary will focus on the scenario of Disponent Owners seeking to discharge Russian origin cargo lifted from an Estonian port, before the new sanctions regime came into effect mid-way through a voyage.  The case highlights the interplay between legal and commercial, encompassing principles of damages, demurrage and freight payments, and a lien over cargo, all against the backdrop of the new global sanctions. The situation highlights the contractual ramifications of deviating under fresh orders and the importance of ongoing due diligence and screening of banking arrangements. The case study comes from a P&I and FD&D insurance perspective with cover issues explored and a discussion of the wider impact of sanctions on the marine insurance industry.

Eleanor Scudder

Eleanor Scudder is a qualified solicitor in England and Wales. Eleanor has an academic background in Law and Social Anthropology. After training and practising in private practice in London and Piraeus she is now working as an in-house lawyer for Skuld, a Norwegian ship insurer based in Oslo. Eleanor handles claims for Owners and Charterers ranging from charterparty disputes, cargo claims, and defence matters. Skuld is one of 13 International Group of P&I Clubs providing liability cover for approx. 90% of the world’s ocean going tonnage. In addition, Eleanor has recently handed over the reins of the role of Secretary General of YoungShip International after two and a half years, a non-profit organisation supporting and promoting young shipping and maritime professionals across 35 offices globally.
